การประกอบธุรกิจของคนต่างด้าว

ตามพระราชบัญญัติการประกอบธุรกิจของคนต่างด้าว พ.ศ.2542กรณีชาวต่างชาติ ไม่ว่าจะมาในรูปของบริษัทที่จดทะเบียนจากต่างประเทศ หรือบริษัทที่จดทะเบียนในประเทศไทยและมีผู้ถือหุ้นตั้งแต่กึ่งหนึ่งขึ้นไปเป็นคนต่างด้าว หากประกอบธุรกิจในบัญชีสามท้าย พ.ร.บ.ฯ จะต้องได้รับอนุญาตจากอธิบดีกรมพัฒนาธุรกิจการค้าโดยความเห็นชอบของคณะกรรมการการประกอบธุรกิจของคนต่างด้าวก่อนจึงจะประกอบธุรกิจได้ (ขอรับใบอนุญาตตามมาตรา17) กรณีต่างด้าวจ้างผู้อื่นผลิตสินค้าแล้วซื้อสินค้ามาขายเข้าข่ายบัญชีสาม (14)ค้าปลีก และ บัญชีสาม (15)ค้าส่ง กรณีให้บริการอื่น เช่น รับจ้างผลิตสินค้า ทำการตลาดให้แก่ลูกค้า ส่งเสริมการขาย เป็นต้นเข้าข่ายบัญชีสาม (21)และบริษัทจะต้องมีทุนขั้นต่ำ (ทุนตามความเป็นจริงที่ใช้ในการประกอบธุรกิจ กรณีบริษัทจดต่างประเทศ คือ เงินที่นำเข้ามาใช้ประกอบธุรกิจในประเทศไทย กรณีบริษัทจดในไทย ดูจากทุนจดทะเบียน) ไม่น้อยกว่า3,000,000บาท ต่อหนึ่งธุรกิจ

แต่หากคนต่างด้าว เป็นสัญชาติอเมริกันและเข้าเงื่อนไขตามสนธิสัญญาไทย-อเมริกัน สามารถขอหนังสือรับรองการประกอบธุรกิจของคนต่างด้าวตามมาตรา11หรือหากได้รับการส่งเสริมการลงทุนจากBOIก็ให้ขอหนังสือรับรองตามมาตรา12
