Firstly, to answer the question about the possibility of reapplication for GSP, the criterion for country graduation under the EU-GSP scheme is that, a country has been classified as "Upper Middle Income” country (by the World Bank, using per capita income) for 3 consecutive years. To this extent, Thailand has reached the "graduation threshold” since 2010. Therefore, as you already know, Thailand has not received the tariff preferences under the EU-GSP scheme since 1 January 2015. This graduation criterion applies to all GSP beneficiary countries, therefore unless our income per capita drops below the "upper middle income” level, there will be no reapplication of EU-GSP.


second, the Council Regulation (EU) 2015/2449, is the regulation to suspend tariffs on raw materials that the EU industries need for their production. The products that will get tariff reduction/suspension are listed in the Annex of this regulation. However, it should be noted that in order to be eligible for tariff suspension, the details of your product have to match both the product code (at 10 digits level) and the description in the table.

For example, the details quoted in your email, it means that the tariff code of your product has to be 3911100081 (CN code+ TARIC) and the product has to be "Non-hydrogenated hydrocarbon resin…….” (the characteristics of your product will have to match the description in this table). IF your product is a match, then the EU importer can get tariff suspension under this regulation. The period of suspension is listed in the last column "End date for mandatory review”. So in this case, the tariff on this particular product will be suspended until the end of 2018.
